8.3 בהתאם לתיקון 13 לחוק הגנת הפרטיות, מאגר הנתונים של החברה כולל פחות מ-10,000 רשומות, ולכן אין חובה למנות ממונה על הגנת מידע (DPO). עם זאת, החברה מיישמת מנגנוני בקרה פנימיים בהתאם לעקרונות ה-GDPR והנחיות רשות הגנת הפרטיות בישראל.
9.1 כל התוכן באתר – לרבות טקסטים, תמונות, עיצוב, קוד מקור וסימנים מסחריים – הוא רכושה הבלעדי של Project Saadia Gaon או של בעלי רישיון מטעמה.
9.2 חל איסור מוחלט להעתיק, לשכפל, להפיץ או לעשות שימוש מסחרי בתכנים ללא רשות מפורשת ובכתב.
9.3 הפרת זכויות יוצרים או סימן מסחר עלולה לגרור הליכים משפטיים לפי הדין החל בישראל ובחו”ל.
10.1 התשלום מתבצע באמצעות מערכות חיצוניות מאובטחות בלבד (PayPal, Stripe או ספק מוסמך של Visa/Mastercard).
10.2 החברה אינה שומרת פרטי כרטיס אשראי.
10.3 העסקאות מתבצעות בהתאם לתקן אבטחת מידע PCI-DSS.
10.4 הלקוח מתחייב למסור פרטים נכונים ומעודכנים.
10.5 שימוש בלתי מורשה או חשד להונאה יאפשר לחברה לבטל את ההזמנה ולנקוט באמצעים משפטיים.
11.1 משלוחים עולמיים ומשלוח חינם: החברה שולחת לכל העולם במשלוח חינם, ללא סכום מינימום להזמנה.
11.2 זמני עיבוד ואספקה: זמן טיפול בהזמנה 2–5 ימי עסקים; זמן משלוח משוער בין שבועיים לחודש, ובמקרים חריגים עד חודשיים.
11.3 משלוח מהיר: ניתן לבקש משלוח מהיר דרך חברות כגון DHL, FedEx או UPS, בתיאום מראש באמצעות הדוא”ל [email protected] ובתוספת תשלום מוסכמת.
11.4 מכס ומסים: הלקוח אחראי לכל מס, מכס או אגרה במדינת היעד.
11.5 מעקב: עם שליחת ההזמנה יישלח מספר מעקב (אם קיים). השליחה תיחשב שהושלמה עם אישור המסירה על-ידי חברת השילוח.
12.1 ניתן לבטל עסקה רק לפני שליחת ההזמנה.
12.2 החזרות יתקבלו רק במקרה של מוצר פגום, שגוי או שניזוק במשלוח.
12.3 יש לפנות בתוך 7 ימים ממועד קבלת המוצר לכתובת [email protected].
12.4 החזר כספי או החלפה יתבצעו בהתאם לשיקול דעת החברה.
12.5 ההחזר, אם אושר, יבוצע בתוך 14 ימי עסקים באמצעות אמצעי התשלום המקורי.
13.1 כל מכירה באתר היא סופית עם אישור התשלום, אלא אם נקבע אחרת על-פי דין.
13.2 החברה שומרת לעצמה את הזכות לבטל או לשנות הזמנה במקרה של הונאה, טעות או חוסר במלאי.
13.3 המוצרים מסופקים “כפי שהם” (As Is), ללא אחריות נוספת.
13.4 החברה מתנערת מכל אחריות משתמעת לשיווקיות או להתאמה למטרה מסוימת.
13.5 אחריות החברה מוגבלת לסכום ששילם הלקוח בפועל עבור המוצר.
14.1 המשתמש מתחייב להזין מידע מדויק, לפעול בהתאם לדין ולא להשתמש באתר באופן שעלול לפגוע בו או בצדדים שלישיים.
14.2 שימוש לרעה באתר, מסירת פרטים כוזבים או פתיחת מחלוקת אשראי שקרית יהוו הפרת הסכם ויובילו לנקיטת הליכים משפטיים.
15.1 החברה לא תישא באחריות לכל נזק עקיף, תוצאתי או עונשי הנובע מהשימוש באתר או במוצריו.
15.2 האחריות למשלוח עוברת ללקוח מרגע העברת החבילה לחברת השילוח.
15.3 אירועים כגון מלחמות, שביתות, אסונות טבע, מגפות או עיכובי מכס ייחשבו ככוח עליון ויפטרו את החברה מאחריות לאספקה במועד.
16.1 התקנון וכל עניין הנובע ממנו כפופים לדיני מדינת ישראל בלבד.
16.2 סמכות השיפוט הבלעדית נתונה לבתי המשפט המוסמכים בעיר תל אביב.
16.3 החברה רשאית לנקוט צעדים משפטיים בכל מדינה אחרת במקרה של פגיעה בקניינה הרוחני.
17.1 תקנון זה מהווה את ההסכם השלם והבלעדי בין הצדדים.
17.2 אם ייקבע שסעיף מהתקנון בטל, יתר הסעיפים יישארו בתוקף מלא.
17.3 ויתור חד-פעמי לא יהווה ויתור על זכות עתידית.
17.4 החברה רשאית להעביר את זכויותיה וחובותיה לצד שלישי ללא הודעה מוקדמת.
